2. Description of Service
Surf Video Scheduler is a platform that enables users to create, edit, and schedule short-form videos for posting across multiple social media platforms including TikTok, Instagram Reels, YouTube Shorts, LinkedIn, Facebook Pages, and Bluesky.
3. User Accounts
3.1 Account Creation
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Account sharing is prohibited.
3.2 Account Responsibilities
You are liable for all activity conducted through your account. You must immediately report any unauthorized access to your account. Creating multiple accounts to bypass subscription plan limits violates these terms.
3.3 Account Termination
We reserve the right to suspend or terminate your account for violations of these terms, fraudulent activity, abusive behavior, or harassment.
4. Social Media Connections
4.1 Authorization
Our service requires OAuth authorization to access your social media accounts. You grant us permission to post content on your behalf according to your scheduling preferences. You can revoke this access at any time through your account settings.
4.2 Platform Compliance
You must comply with the terms of service and community guidelines of each social media platform you connect to our service. We are not responsible for enforcement actions taken by these platforms.
4.3 Platform Changes
We are not responsible for changes, limitations, or disruptions to social media platform APIs that may affect our service functionality.
5. Acceptable Use Policy
5.1 Permitted Use
You may use our service for video creation, scheduling posts, managing multiple social media accounts, and using AI-powered features to enhance your content.
5.2 Prohibited Use
You agree not to:
- Post illegal content or content that violates intellectual property rights
- Engage in spam, harassment, or misinformation campaigns
- Attempt unauthorized access to our systems or other users' accounts
- Use automated tools (bots) except for the scheduling functionality we provide
- Resell or redistribute our platform services
- Violate community guidelines of connected social media platforms
6. Intellectual Property Rights
6.1 Your Content
You retain all ownership rights to the content you create and upload through our service. By uploading content, you grant us only the license necessary to store, process, and transmit your content for the purpose of providing our services.
6.2 Our Platform
All intellectual property rights in our service, including software, design, and trademarks, belong to us and our licensors.
6.3 Third-Party Content
You are responsible for ensuring you have the necessary rights and licenses for any third-party content you use in your videos.
7. Subscription Plans and Billing
7.1 Plan Types
We offer multiple subscription tiers: Free, Basic, Pro, and Agency. Each plan has different features, limits, and pricing.
7.2 Billing
Subscriptions are billed monthly or annually in USD through Stripe. All fees are exclusive of taxes. We provide 30 days notice for price changes.
7.3 Refunds
Monthly plans have no refunds for partial months. Annual plans offer pro-rated refunds within the first 30 days of purchase.
7.4 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle.
8. Credit System
8.1 Credit Usage
Credits are used for AI-powered features like caption generation. Monthly credits reset at the beginning of each billing cycle and do not carry over. Credits are non-transferable.
8.2 Credit Limitations
Credits have no cash value and cannot be redeemed for money. We reserve the right to adjust credit costs for AI features.
9. Service Availability
9.1 Uptime
We target 99.9% uptime but do not guarantee uninterrupted service. We are not liable for service interruptions or data loss.
9.2 Limitations
We may impose limits on file uploads, storage capacity, and API rate limits based on your subscription plan.
10. Data and Privacy
10.1 Data Security
We implement industry-standard security measures to protect your data, though we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials.
10.2 Data Backup
We perform regular backups but do not guarantee data recovery. You should maintain independent backups of important content.
11. Limitation of Liability
The Service is provided "AS IS" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid in the last 12 months.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the service, violations of these terms, or infringement of third-party rights.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the applicable jurisdiction.
13.2 Arbitration
Disputes will be resolved through binding arbitration, except for intellectual property claims, injunctive relief, or small claims court matters.
14. Changes to Terms
We may modify these Terms at any time. Changes will be communicated through website updates, date modifications, and email notifications. Continued use after changes indicates acceptance.
15. Termination
15.1 By You
You may close your account at any time. Upon closure, scheduled posts will be cancelled and your data will be deleted within 30 days.
15.2 By Us
We may terminate your account for violations of these terms, non-payment, or serious breaches. Immediate termination is possible for severe violations.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the complete agreement between you and us.
16.2 Severability
If any provision is found unenforceable, the remaining provisions will continue in effect.
16.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
16.4 Assignment
You may not assign these Terms without our consent. We may assign these Terms to affiliates or successors.
